1.1.

These terms and conditions set out the basis on which you can use our website and place orders for items from Viva Print. By ordering goods from Viva Print you are deemed to have understood and accepted these terms. The supplier of the goods featured is Viva Print, a trading name of Viva Print & Design Ltd, ("Viva Print", "we", or "us"). Registered office Aelybryn, Cilsanws Lane, Cefn Coed, CF48 2NU. Registered number 06816788 (England & Wales).

 

1.2.

You may contact us at this address or by email to contact@viva-print.co.uk or phone us on 0844 410 0105. Telephone calls to and from Viva Print may be recorded or monitored as part of our efforts to further improve service to our customers.

 

1.3.

Unless stated otherwise, all calls to Viva Print cost 5 pence per minute from a BT landline, Mobile Providers and other Networks may vary.

 

 

 

 

2.

Image Cropping and Gallery Wrapping

 

2.1.

To fit your photo onto the specified canvas size we will often have to crop the original photo. We will do this with the utmost sensitivity to retain the original feel of the image but we will not be held responsible for cropping out any part of the image. If there are specific parts of the photo that you would like to keep on the front of the canvas you should let us know in advance.

 

2.2.

Gallery Wrapping is also a popular choice but to "wrap" the image the photo must be enlarged to cover the edges of the frame. Our frames have a depth of 38mm and we therefore have to enlarge your image by 76mm in length and width to cover these edges. Sometimes this will lead to an important part of your photo ending up on the side of the canvas (for example part of a face, an eye, or a large part of a head). In these circumstances we reserve the right to not Gallery Wrap your image, we will instead print the photo on the front of the canvas using a Mirror Wrap option.

 

2.3.

For images that do not fit our standard frames sizes it may be nessersay to amend your order and have white space either at the top and bottom or each side of the print. To avoid this please consider selecting a custom size frame or contact us prior to ordering.

 

 

 

 

3.

Colour & Image Quality

 

3.1.

Whilst we try our very best to colour match every photo we cannot be held responsible for exact colour matching requirements. Colours may appear differently on your computer screen than ours (due to contrast, hue settings on your monitor) and we will not accept returns for colour related issues. If exact colour matching is important then we suggest contacting us to discuss test samples.

 

3.2.

If you are concerned about the print quality of an image at a particular size, please contact us before placing an order to request a free proof, it is too late after the order has been placed! All orders placed are automatically sent to print, for this reason we are not able to replace/refund any order where a customer is not satisfied with the print quality of their image and a proof was not requested.

 

3.3.

Please ensure that you e-mail or upload a full size, high quality version of your image, not a thumbnail. Orders are sent to print automatically, we do not view or check images before print unless "Photo Touch Up" has been selected. Refunds or reprints will not be offered where a customer has provided a low quality, poor resolution image, this is customer error, not a print error.

 

 

 

 

4.

Delivery, Title and Risk

 

4.1.

Viva Print shall use reasonable endeavours to despatch goods by the date agreed with the customer, but does not accept liability for failure to deliver within the stated time where this is caused by circumstances beyond our reasonable control, such as delays caused by delivery companies or manufacturer lead times.

 

4.2.

Viva Print does not accept liability for shortages or damage to deliveries unless the Customer notifies us of the shortage or damage in writing within 48 hours of receipt of the delivery. Please ensure that all packages are checked for any signs of damage before signing for your consignment. We will not be liable for replacing or refunding any damaged items that have not been checked before signing for the consignment(s). If a consignment is found to be damaged please sign for the consignment as damaged.

 

4.3.

Business Customers are required to be able to accept the goods when they are ready for delivery within Normal Working Hours.

 

4.4.

Delivery is deemed to take place when the goods are delivered to the Customer's nominated address, whereupon the risks of loss, breakage and all damage and all other risks shall pass to the Customer.

 

4.5.

Title in the goods does not pass to the Customer until payment is received in full.

 

4.6.

If the Customer cannot accept delivery for any reason, Viva Print reserves the right to:

 

 

4.6.1.

store and insure the goods at the Customer's expense and risk or

 

 

4.6.2.

sell the goods at the best price reasonably obtainable and (after deducting reasonable storage insurance and selling costs) pay to the Customer any excess over the sale price or charge the Customer for any shortfall or

 

 

4.6.3.

re-arrange delivery provided that Viva Print may charge the Customer for the additional delivery costs incurred.

 

4.7.

Upon delivery of the goods, the Customer will be asked to sign a Proof of Delivery to acknowledge safe receipt. It is the responsibility of the Customer to ensure that the number of packages delivered corresponds with the number stated on the delivery note. Where a discrepancy occurs or where there is evident damage to the packaging, this should be noted on the Proof of Delivery. We shall not be liable for discrepancies or damage evident on delivery where the Customer accepts delivery and signs the Proof of Delivery without amendment.

 

4.8.

Delivery of goods can take up to 28 days.

 

4.9.

Viva Print will endeavour to ensure that goods are delivered on the date stated in the selected delivery method at the time of purchase however Viva Print cannot be held responsible for delays caused via couriers and consequently are not obliged to refund delivery or order charges in these cases.

 

 

 

 

5.

Returns & Cancellation

 

5.1.

Viva Print is committed to providing our customers with the highest quality products and service. However, on rare occasions, products may be found to be faulty or defective. In such cases we offer the returns or exchange facilities described below.

 

5.2.

Please note that due to the personalised, bespoke nature of our "Photo Canvas" and "Photo Poster" items the right to cancel under the Consumer Protection (Distance Selling) Regulations 2000 does not apply to these products. For more information please see section 13 (Exceptions to the right to cancel) in the Consumer Protection act.

 

5.3.

Returns for refund can only be made on stock items or where an item is found to be faulty.

 

5.4.

We are happy to accept returns for refund on any stock items within 14 days of receipt. Please note that shipping costs will not be refunded unless the item is found to be faulty. Refunds will be completed on return of the item to us

 

5.5.

All cancelled orders will incur a cancellation charge of 25%, this is to cover administration costs and production costs of any part products that may have been made.

 

 

 

 

6.

Your Responsibility

 

6.1.

It is the customers responsibility to ensure that their contact details are kept up to date and that any issues raised are responded to in a timely fashion. Examples of this include, but are not limited to Size, Colour and Image Quality. In these circumstances Viva Print will attempt to contact the customer, if there has been no response by the dispatch date Viva Print will complete the order according to the original specifications. Viva Print cannot be held responsible for any issues raised or responded to after an order has been printed or dispatched.

 

6.2.

Delivery options in the cart will vary depending on delivery location. Customers are responsible for selecting the correct delivery location and method at the time of placing an order. Viva Print reserves the right to retain any shipment where inadequate postage has been paid.

 

6.3.

The shipping address provided by in PayPal is the only address we will ship your order to. You can view and edit your delivery address within PayPal during the order process. The customer will be responsible for any charges incurred by us for an item that has been shipped to an incorrect address.

 

 

 

 

7.

Product specifications

 

7.1.

Viva Print makes every effort to supply the goods as advertised but reserves the right to supply the goods subject to minor variations in actual dimensions and specifications stated. All orders will be produced using the information provided by the customer at the time of order and we will not be held responsible for any errors in order specifications submitted by the customer.

 

 

 

 

8.

Copyright

 

8.1.

Any images submitted to us for print or any other purposes must not be used if you do not hold copyright to image, or if you do not have written consent from the copyright holder. In submitting the image to print you agree that full autorisation for the reproduction and distribution of the image and hold full responsibility to any infringements of copyright of the image.
